The Case in One Paragraph
In June 2025, Milagros Garcia reported safety violations at Bayport Laboratories, LLC — a Houston-area cosmetics manufacturer. Within seven days she was terminated. Bayport then filed a $5 million state-court suit against her, obtained an ex parte TRO ordering her to withdraw her federal OSHA complaint and destroy her evidence, and pulled in her adult daughter Giselle Garcia, a documented sexual-assault and trafficking survivor with no employment relationship to the company. The FDA later inspected Bayport and independently documented the safety violations Milagros had reported. The Garcias' federal case, Garcia v. Bayport Laboratories, LLC, et al., No. 4:25-cv-3676 (S.D. Tex.), is pending before the Hon. Keith P. Ellison. The Texas state court that issued the TRO subsequently dissolved the related Temporary Injunction on January 20, 2026.

Third-party retaliation against a trafficking survivor. Giselle Garcia, a non-employee, was named in the litigation; her home address became visible through court filings and her abusers reportedly located her.
Insurance bad faith / Stowers. A $930,000 within-limits Stowers demand was sent on January 4, 2026, with a curative demand in early March 2026. Carriers identified to date: Scottsdale Indemnity Company / Nationwide Professional & Specialty Claims (Policy EKI3547741, EPL coverage).

Regulatory failure cluster. OSHA, the Texas state court, and the FDA each had a chance to intervene early. The FDA inspection (EIR 1773711606) confirmed the violations Milagros had reported.
